South Africa – March 21, 2024 – On this Human Rights Day, Kwanele stands in solidarity with womxn across South Africa demanding urgent action to address the dire state of access to justice in the country. While South Africa boasts a progressive constitution, the reality on the ground paints a starkly different picture, where justice remains elusive for countless individuals, particularly womxn.
Yesterday, a harrowing incident unfolded in Temba Magistrate Court in the North West, highlighting the urgent need for reform. Hope, a courageous 21-year-old, bravely appeared in court to seek justice against the man who has terrorized her for two years. Despite having a protection order in place and enduring relentless stalking and threats, Hope’s cries for justice fell on deaf ears as she faced her tormentor in court.
The accused brazenly harassed and threatened Hope in full view of law enforcement and the prosecution, yet no action was taken. Shockingly, when Hope’s court supporter alerted the prosecutor and the police person in the court to the ongoing harassment, the accused was not confronted or forced to stop his intimidation tactics. This blatant disregard for Hope’s safety and rights underscores the urgent need for systemic change.
His intimidation tactics extend beyond Hope, as he has targeted her friends, her family, and even her niece, instilling fear and anxiety in their daily lives. Despite numerous reports to the police, the authorities have remained passive, failing in their duty to protect and serve.
This egregious miscarriage of justice is not an isolated incident but emblematic of a systemic failure to uphold the rights of womxn in South Africa. Protection orders, police forces, and judicial systems lose their meaning when they fail to enforce the law and safeguard the vulnerable.
Kwanele calls upon SAPS SJ Lehare to take immediate and decisive action to address this urgent situation. Human Rights Day serves as a poignant reminder of the inherent dignity and rights of all individuals, and it is imperative that these rights are upheld without exception.
Furthermore, we urge the Temba Magistrate Court and courts across South Africa to ensure that justice is served swiftly and effectively in cases like Hope’s. The lives of countless womxn hang in the balance, and the time for action is now.
